2. Purposes of personal data processing
We process your personal data for the following purposes:
Processing in connection with concluding a sales contract with you:
- If we conclude a sales contract with you, we process your data in order to perform this contract. We may also process your personal data, at your request, before concluding the contract, in order to take steps to conclude it. The legal basis for data processing in this regard is Art. 6 sec. 1 b) GDPR, i.e. the necessity to perform the concluded contract or to take action at the request of the data subject before its conclusion. In addition, since the conclusion of the contract results in additional obligations for us (e.g. in tax matters), the legal basis for data processing is also art. 6 sec. 1c) GDPR, i.e. the necessity of data to comply with a legal obligation.
- We process your data on the basis of art. 6 sec. 1 f) GDPR, i.e. in order to pursue our legitimate interests - if you submit a complaint or a dispute arises between us regarding the performance of the contract, we may process your data in order to consider and handle complaints as well as to establish, pursue or defend claims.
- If you contact us via e-mail, we may process your data in order to correspond with you. The basis for data processing will be art. 6 sec. 1 f) GDPR, i.e. our legitimate interest.
- If you have expressed your willingness to receive a newsletter or other commercial information from us by e-mail or telephone, the basis for the processing of your data by us is art. 6 sec. 1 a) GDPR, i.e. your consent.
- We may also process your personal data for direct marketing of our products and services via traditional mail. In such a situation, the legal basis for processing will be art. 6 sec. 1 f) GDPR, i.e. our legitimate interests.
- If a contact form is available on the website, we will process the data to enable contact. The basis for processing is art. 6 sec. 1 f) GDPR, i.e. our legitimate interests.
- In order to enable the proper functioning of the website, its administration and ensuring security, we may process data collected during visits to it. This data will not be used to identify specific users. The basis for processing is art. 6 sec. 1 f) GDPR, i.e. our legitimate interests.
- Due to our legitimate interests, we can process your data collected on EMI portals on the following portals: Facebook and Instagram in order to ensure the functioning of the profile (in particular, to inform users about our products and services, about events in which we participate as well as about people with whom we work with) and interacting with users. The basis for processing is art. 6 sec. 1 f) GDPR, i.e. our legally justified interests.
Providing your personal data is voluntary, provided that:
- If you conclude a contract with us, providing your data will be necessary for us to perform and settle it. This applies to data such as your name, address, e-mail, telephone number. Similarly, if you submit a complaint, we need to receive your data in order to consider and handle it. We will also process data on the details of our cooperation;
- If you contact us via e-mail, the processing of your data such as e-mail address, name, surname and any information provided in the content of the message is necessary for us to be able to correspond with you;
- If you agree, your e-mail address and telephone number may be processed for the purpose of sending you marketing information by electronic means;
- If you use our website, we collect your data, including your IP address, to enable the website to function properly, to administer it and to ensure its security;
- In the case of visits to our profiles on Facebook and Instagram, the processing of your data such as name, surname and image is necessary to use the services offered by this portal.
We will store your data for the following periods:
- in the case of data necessary for the performance of the contract concluded with you and the fulfillment of legal obligations incumbent on us in connection with its conclusion - for the time necessary for this, i.e. until the expiry of the limitation period for claims arising from the contract or related tax liabilities - any of these periods will expire later;
- in the case of data processed on the basis of your consent, the data will be processed until it is withdrawn;
- in the case of data for which the basis for processing is our legitimate interests, the data will be processed as long as it is necessary to achieve the purpose of processing, with the proviso that: - in the event of an objection, the processing will be completed upon its receipt, unless:
- our interests outweigh your interests, rights or freedoms - in this case we will continue to process the data, but no longer than it is necessary to achieve the purpose of processing;
- we need your data to establish, pursue or defend claims - in this case, we will process the data until the final conclusion of court or enforcement proceedings (if any).

6. Cookies
On our website, we use cookies, i.e. small text files that are installed and stored on your end device (e.g. computer, smartphone). Cookies contain the domain name of our website, their storage time on your end device and a unique identifier. Thanks to cookies, we know when you use our website, how long you stay on it and from what place in the world you log in to it. However, we do not know your identity and do not try to determine it.

7. Transfer of personal data

Due to the fact that we use external providers of various services, e.g. Facebook, Google, Microsoft, Instagram, etc., your data may be transferred to third countries, e.g. to the United States. However, they will only be transferred to those recipients who have joined the so-called Privacy Shield, or who guarantee adequate protection of your data. Your data will not be processed in an automated manner, including in the form of profiling.
